Frequently Asked Questions

How much does an estate have to be worth for probate in Texas?

You may qualify to skip the probate process and sign a Small Estate Affidavit if your loved one’s estate is valued at less than $75,000.

What if I disagree with the appointment of an administrator?

When a person dies without a will naming an executor (intestate succession), the probate court will appoint an administrator. If the heirs can not agree on who should be the estate administrator, the court will appoint a dependent administrator.

This means that the person ultimately appointed will have their administrative duties scrutinized by the probate court, limiting their independent decision-making.

Is there a way I can help my loved ones avoid probate of my estate in Texas?

You can create a revocable or living trust document for assets you own, like your home, vehicles, and bank accounts. These assets will bypass probate and be distributed promptly to your designated beneficiaries by your trustee upon your death.
